Jennie B Travels - General Terms & Conditions

Please read these Terms & Conditions ("Terms") carefully before using the travel planning services of JMB SQ'D LLC, doing business as Jennie B Travels ("we," "us," "our"). By engaging our services, you ("client," "you," "your") agree to be bound by these Terms.

1. Scope of Services & Our Role
Jennie B Travels is an independent travel agency that acts as an agent for travel suppliers, such as airlines, cruise lines, hotels, tour operators, and other third-party providers (collectively, "Suppliers"). We use our expertise to research, plan, and arrange travel itineraries on your behalf. Our services are provided under our affiliation with Legato Travel, LLC, a registered Seller of Travel.

We are not the provider of travel services. We are not liable for the acts, omissions, or financial defaults of any Supplier. Your booking is subject to each individual Supplier’s terms and conditions, which you will be provided with and must agree to at the time of booking.

2. Planning Process & Fees
2.1. Complimentary Consultation: Our process begins with a complimentary initial consultation to discuss your travel vision, our process, and to determine if we are a strategic fit. No research or proposals will be provided during this call.

2.2. 'Concierge Care' Planning Fee: To engage our professional design and research services, a non-refundable 'Concierge Care' planning fee is required. This fee covers our time for initial research, itinerary development, and booking management. The planning fee starts at $50 per person and is customized based on the number of travelers and the complexity of the itinerary. The exact fee will be quoted to you following our initial consultation.

2.3. Itinerary Proposal & Revisions: The planning process officially begins after the 'Concierge Care' planning fee has been paid. Following payment, we will research and present you with a "first and best" itinerary proposal tailored to your vision. This proposal includes one round of reasonable revisions.

2.4. Itinerary Changes: A complete change in destination, travel style, or dates after the initial proposal has been delivered will be considered a new trip and will require a new non-refundable 'Concierge Care' planning fee.

3. Booking & Payments
Once you approve an itinerary, we will proceed with booking the travel components. Payments for travel services (flights, cruises, hotels, etc.) are typically made directly to the Suppliers or our host agency, Legato Travel, LLC. You will be required to provide a valid credit card for these bookings and authorize us to use it to make payments on your behalf. You are responsible for ensuring your payment information is accurate.

4. Cancellations & Refunds
4.1. Planning Fee: All 'Concierge Care' planning fees are non-refundable once paid, as they compensate us for our time, expertise, and the professional services already rendered.

4.2. Supplier Cancellations: Cancellation of booked travel is subject to the terms and conditions of the individual Suppliers. Each Supplier has its own cancellation policies and penalties. We will assist you in navigating the cancellation process, but we are not responsible for Supplier penalties, the issuance of refunds, or any non-refundable deposits made to them. Jennie B Travels does not charge an additional cancellation fee.

5. Client Responsibilities
5.1. Travel Documents: You are responsible for ensuring that all travelers have valid passports, visas, and any other required travel documents for the destinations on your itinerary. Passports should be valid for at least six (6) months beyond your planned return date.

5.2. Review of Documents: You agree to review all booking confirmations and travel itineraries for accuracy upon receipt and to inform us immediately of any discrepancies.

5.3. Travel Insurance: We strongly recommend that all clients purchase comprehensive travel insurance to protect against unforeseen circumstances such as trip cancellation, interruption, medical emergencies, and baggage loss. We can provide quotes for travel insurance plans.

5.4. Intellectual Property: The itinerary proposals, research, and planning documents provided by us are our intellectual property. You agree not to use this information to book travel services directly without our involvement.

5.5. Guest Responsibility: For all group bookings, including destination weddings, you are responsible for the actions and financial obligations of your guests. We will provide a separate acknowledgment form for each guest to sign.

6. Limitation of Liability
Jennie B Travels acts only as an agent for the Suppliers. We are not responsible for the acts, errors, omissions, or negligence of any Supplier or for any personal injuries, property damage, or other damages or expenses resulting therefrom. The services provided by Suppliers are subject to their own terms and conditions. Our liability shall not exceed the total amount of the planning fees you have paid to us.

7. Dispute Resolution & Governing Law
7.1. Chargebacks: You agree to first contact us directly in writing to resolve any disputes before initiating a chargeback with your credit card company. If a chargeback is initiated and we prevail, you agree to reimburse us for any fees or legal costs we incur.

7.2. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States.

8. Changes to These Terms
We reserve the right to modify these Terms at any time. Any changes will be posted on our website and will be effective immediately.

Please read these Group Travel Terms & Conditions ("Terms") carefully before using the group travel planning and management services of JMB SQ'D LLC, doing business as Jennie B Travels ("we," "us," "our").

By engaging our services, whether as a "Group Leader," "Host Organization," or "Participant," you ("client," "you," "your") agree to be bound by these Terms. These Terms apply to all group bookings, including but not limited to escorted groups, corporate and organizational travel (MICE), destination weddings, and events at sea.

1. Scope of Services & Our Role
Jennie B Travels is an independent travel agency that acts as an agent for travel suppliers, such as airlines, cruise lines, hotels, tour operators, and other third-party providers (collectively, "Suppliers"). We use our expertise to research, plan, and arrange group travel itineraries on your behalf. Our services are provided under our affiliation with Legato Travel, LLC, a registered Seller of Travel.

We are not the provider of travel services. We are not liable for the acts, omissions, or financial defaults of any Supplier. Your booking is subject to each individual Supplier’s terms and conditions, which will be provided and must be agreed to.

2. Definitions

2.1. Group Leader / Host Organization: The primary entity or individual(s) (e.g., the wedding couple, the corporate entity, the Chamber of Commerce) responsible for making key decisions, disseminating information, and potentially making initial group deposits on behalf of the group.

2.2. Participant: Each individual traveler within the group, including the Group Leader, who will be part of the group reservation.

2.3. Group Agreement: The specific proposal and contract provided by us to the Group Leader / Host Organization, which outlines the detailed itinerary, inclusions, group pricing, payment schedule, and Supplier cancellation policies for a specific trip.

3. Planning Process & Fees

3.1. Complimentary Consultation: Our process begins with a complimentary initial consultation to discuss your group's travel vision, our process, and to determine if we are a strategic fit.

3.2. Group Management & Planning Fee: To engage our professional design, research, and group management services, a non-refundable Group Management & Planning Fee is required. This fee is customized based on the complexity of the trip, the number of participants, and the management required. It may be structured as a flat fee for the Host Organization or a per-person fee for Participants. This fee is non-refundable once paid, as it compensates us for our time, expertise, and services rendered. The-fee structure will be outlined in the Group Agreement.

3.3. Itinerary Changes: A complete change in destination, travel style, or dates after the Group Agreement has been delivered will be considered a new trip and will require a new non-refundable Group Management & Planning Fee.

4. Group Pricing, Deposits & Payments

4.1. Pricing & Minimums: All group pricing is based on a minimum number of paying Participants traveling together, as specified in the Group Agreement. Should the number of Participants fall below this minimum, we and the Suppliers reserve the right to re-price the trip for all remaining Participants, which may result in a higher per-person cost.

4.2. Deposits & Payment Schedule: A Group Agreement will be issued detailing all group deposits, due dates, and the final payment schedule. This may include an initial deposit from the Group Leader / Host Organization to secure the group block, followed by individual deposits and final payments from each Participant.

4.3. Participant Payments: Each Participant is responsible for making their payments by the due dates specified. Payments for travel services are typically made directly to the Suppliers or our host agency, Legato Travel, LLC. You will be required to provide a valid credit card and authorize us to use it for these payments.

4.4. Late Payments: Failure to make payments on time may result in the Supplier's automatic cancellation of your reservation, forfeiture of all monies paid, and a late fee.

5. Cancellations, Refunds & Attrition

5.1. Planning/Management Fee: All Group Management & Planning Fees are non-refundable.

5.2. Cancellation by a Participant: If a Participant cancels, their cancellation is subject to the specific terms, conditions, and penalties of the Suppliers, as outlined in the Group Agreement.

5.3. Attrition & Price Adjustments: The cancellation of one or more Participants may affect the per-person price for all remaining Participants. If a cancellation causes the group's numbers to fall below a pricing tier or group minimum, the remaining Participants will be responsible for any resulting price increase.

5.4. Cancellation by Group Leader / Host Organization: If the entire group trip is canceled by the Group Leader or Host Organization, they are liable for all non-refundable deposits, planning fees, and any group cancellation penalties levied by the Suppliers as detailed in the Group Agreement.

5.5. Our Role in Cancellations: We will assist you in navigating the cancellation process, but we are not responsible for Supplier penalties, the issuance of refunds, or any non-refundable deposits made to them. Jennie B Travels does not charge an additional cancellation fee.

6. Client & Participant Responsibilities

6.1. Group Leader / Host Organization Responsibilities:

To act as the primary liaison between Jennie B Travels and the group Participants.

To review the Group Agreement for accuracy before signing and distributing it.

To disseminate all official travel information (itineraries, invoices, payment reminders, changes) to all Participants in a timely manner.

To make decisions on behalf of the group for any group-wide components.

6.2. Individual Participant Responsibilities:

Travel Documents: You are responsible for ensuring you (and any minors you are responsible for) have valid passports, visas, and any other required travel documents. Passports must be valid for at least six (6) months beyond your planned return date.

Review of Documents: You agree to review all your personal booking confirmations and invoices for accuracy upon receipt and to inform us immediately of any discrepancies.

Conduct: You agree to act in a responsible manner and to not disrupt the enjoyment of other group members. We and our Suppliers reserve the right to remove any Participant from the group at their own expense for behavior that is disruptive, dangerous, or illegal.

6.3. Travel Insurance: We strongly recommend that every Participant purchase comprehensive travel insurance to protect against unforeseen circumstances, including trip cancellation, interruption, medical emergencies, and supplier default. We can provide quotes for travel insurance plans.

6.4. Intellectual Property: The itinerary proposals, research, and planning documents provided by us are our intellectual property. You agree not to use this information to book travel services directly without our involvement.
