Please read these Terms & Conditions ("Terms") carefully before using the travel planning services of Jennie B Travels ltd ("we," "us," "our"). By engaging our services, you ("client," "you," "your") agree to be bound by these Terms.
1. Scope of Services & Our Role
Jennie B Travels is an independent travel agency that acts as an agent for travel suppliers, such as airlines, cruise lines, hotels, tour operators, and other third-party providers (collectively, "Suppliers"). We use our expertise to research, plan, and arrange travel itineraries on your behalf. Our services are provided under our affiliation with Legato Travel, LLC, a registered Seller of Travel for residents of California (CA), Hawaii (HI), Florida (FL), and Washington (WA).
We are not the provider of travel services. We are not liable for the acts, omissions, or financial defaults of any Supplier. Your booking is subject to each individual Supplier’s terms and conditions, which you will be provided with and must agree to at the time of booking.
2. Planning Process & Fees
2.1. Complimentary Consultation: Our process begins with a complimentary initial consultation to discuss your travel vision, our process, and to determine if we are a strategic fit. No research or proposals will be provided during this call.
2.2. Professional Planning/Servicing Fee: To begin working together on a trip, a professional planning and service fee is required. Once service fee is paid in full, Jennie B Travels will plan and confirm travel arrangements as agreed. This fee is separate from the cost of your trip and is non-refundable.
*Note: All service fees incurred are due to Jennie B Travels, non-refundable, and in addition to any fees and penalties imposed by each individual supplier/vendor booked with.
2.3. Itinerary Proposal & Revisions: The planning process officially begins after the planning fee has been paid. Following payment, we will research and present you with a "first and best" itinerary proposal tailored to your vision. This proposal includes one round of reasonable revisions. See Service Fee Structure for additional revision/change fees.
2.4. Itinerary Changes: A complete change in destination, travel style, or dates after the initial proposal has been delivered will be considered a new trip and will require a new non-refundable Professional Planning & Servicing fee.
3. Booking & Payments
Once you approve an itinerary, we will proceed with booking the travel components. Prices provided in itineraries and proposals are subject to availability and are not guaranteed until a deposit or full payment has been successfully processed by the Supplier. Payments for travel services (flights, cruises, hotels, etc.) are typically made directly to the Suppliers. You will be required to provide a valid credit card for these bookings and authorize us to use it to make payments on your behalf. You are responsible for ensuring your payment information is accurate. In the event a supplier requires payment via wire transfer, or does not accept direct payment by means of the client's credit card, the client will be invoiced by Jennie B Travels for the funds and payment will be made by Jennie B Travels.
Please note that all prices provided in itineraries, proposals, and quotes are subject to dynamic pricing and availability by the Suppliers. Prices are never guaranteed until a deposit or full payment has been successfully processed and a confirmation number has been issued by the Supplier.
4. Cancellations & Refunds
4.1. Planning Fee: All fees are non-refundable once paid, as they compensate us for our time, expertise, and the professional services already rendered.
4.2. Supplier Cancellations: Cancellation of booked travel is subject to the terms and conditions of the individual Suppliers. Each Supplier has its own cancellation policies and penalties. We will assist you in navigating the cancellation process, but we are not responsible for Supplier penalties, the issuance of refunds, or any non-refundable deposits made to them. Jennie B Travels does not charge an additional cancellation fee.
4.3 Service Fee Structure
Professional Planning/Servicing Fee: $1000 up to 10 day itinerary, $100 per additional day
Domestic Air Ticketing Fee, per person: $50
International Air Ticketing Fee, per person: $100
Frequent Flyer/ Award Booking Fee, per person: $50
Change Fee: $50 per person/per change up to the limit allowed by supplier/vendor
5. Client Responsibilities
Clients are solely responsible for checking and fulfilling all travel requirements for their destinations. This includes, but is not limited to, checking the U.S. State Department for travel advisories and the CDC for health requirements, including necessary vaccinations, entry protocols, and required visas. Jennie B Travels ltd is not liable for any financial losses or disruptions due to a client's failure to meet these requirements.
5.1. Travel Documents: You are responsible for ensuring that all travelers have valid passports, visas, and any other required travel documents for the destinations on your itinerary. Passports should be valid for at least six (6) months beyond your planned return date. You are responsible for providing the exact full legal names of all travelers as they appear on their government-issued ID or passport. Jennie B Travels is not responsible for any change fees, denial of boarding, or cancellations resulting from incorrect names provided by the client.
5.2. Review of Documents: You agree to review all booking confirmations and travel itineraries for accuracy upon receipt and to inform us immediately of any discrepancies.
5.3. Travel Insurance: We strongly recommend that all clients purchase comprehensive travel insurance to protect against unforeseen circumstances such as trip cancellation, interruption, medical emergencies, and baggage loss. We can provide quotes for travel insurance plans. If you choose to decline travel insurance, you assume all financial risk and liability for any cancellation penalties, medical expenses, or travel disruptions, and you will be required to sign a waiver acknowledging your refusal of coverage.
5.4. Intellectual Property: The itinerary proposals, research, and planning documents provided by us are our intellectual property. You agree not to use this information to book travel services directly without our involvement.
5.5. Guest Responsibility: For all group bookings, including destination weddings, you are responsible for the actions and financial obligations of your guests. We will provide a separate acknowledgment form for each guest to sign.
6. Limitation of Liability
Jennie B Travels acts only as an agent for the Suppliers. We are not responsible for the acts, errors, omissions, or negligence of any Supplier or for any personal injuries, property damage, or other damages or expenses resulting therefrom. The services provided by Suppliers are subject to their own terms and conditions. Our liability shall not exceed the total amount of the planning fees you have paid to us.
6.1. Force Majeure (Acts of God): Jennie B Travels ltd shall not be liable for any total or partial failure to perform its obligations under these Terms, nor for any delays, cancellations, financial losses, or damages, caused by circumstances beyond our reasonable control. Such circumstances include, but are not limited to, Acts of God, extreme weather, natural disasters, pandemics, epidemics, government mandates or travel restrictions, strikes or labor disputes, acts of terrorism, or war (collectively referred to as "Force Majeure"). In the event of a Force Majeure occurrence resulting in the cancellation, delay, or alteration of your travel plans, please note that all Professional Planning & Servicing Fees paid to Jennie B Travels ltd remain strictly non-refundable, as they compensate us for services already rendered. Any refunds or credits for the travel components themselves will be entirely dictated by the individual Suppliers' policies.
7. Dispute Resolution & Governing Law
7.1. Chargebacks: You agree to first contact us directly in writing to resolve any disputes before initiating a chargeback with your credit card company. By electronically signing our authorization forms, you acknowledge our non-refundable fee policies. If a chargeback is initiated for a properly processed supplier charge or a non-refundable agency fee, we reserve the right to dispute the chargeback using your signed authorization. If we prevail, or if the chargeback is deemed fraudulent, you agree to reimburse us for any fees, chargeback penalties, or legal costs we incur, and we reserve the right to send unpaid invoices to a collections agency.
7.2. Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States.
8. Changes to These Terms
We reserve the right to modify these Terms at any time. Any changes will be posted on our website and will be effective immediately.
